Islas Paraiso Expedition Company

By booking and participating in any expedition, tour, or activity organized by Islas Paraiso Expedition Company (“the Company”), guests acknowledge that they have read, understood, and agreed to the following Terms and Conditions.

1. Assumption of Risk and Accidents

1.1 Inherent Risks

Participation in expeditions involves inherent risks, including but not limited to rough terrain, weather changes, marine conditions, equipment use, and physical activity.

1.2 Voluntary Assumption of Responsibility

Guests voluntarily assume full responsibility for any risks of injury, illness, loss, or damage that may occur during the expedition.

1.3 Limitation of Liability

The Company shall not be held liable for accidents, injuries, illness, death, or loss of personal belongings unless caused by proven gross negligence of the Company.

1.4 Guest Responsibilities

Guests are responsible for:

  • Disclosing any medical conditions that may affect participation
  • Following all safety instructions provided by guides and staff
  • Wearing required safety equipment at all times

1.5 Removal From Expedition

The Company reserves the right to remove any participant from an expedition if their behavior poses a risk to themselves or others, without refund.

2. Refund and Cancellation Policy

2.1 Guest-Initiated Cancellations

Refunds are subject to the Company’s cancellation timeline and may include administrative fees. No refunds will be issued for failure to appear (“no-shows”) or early departure from an expedition.

2.2 Company-Initiated Cancellations

If the Company cancels an expedition due to safety concerns, operational issues, or weather conditions, guests may be offered:

  • A full refund, or
  • Rescheduling to a future expedition (subject to availability)

2.3 Non-Refundable Costs

The Company is not responsible for additional expenses such as transportation, accommodation, meals, or personal arrangements made by the guest.

3. Weather Conditions and Force Majeure

3.1 Weather and Natural Conditions

Expeditions are subject to weather, sea conditions, and natural factors beyond the Company’s control.

3.2 Changes to Itinerary

The Company reserves the right to:

  • Modify routes, schedules, or activities
  • Delay, reschedule, or cancel an expedition
  • Substitute activities of equal value when possible

3.3 Weather and Refunds

Unfavorable weather conditions do not automatically guarantee a refund, unless the expedition is canceled entirely by the Company.

3.4 Force Majeure

The Company shall not be held liable for delays, interruptions, or cancellations caused by events beyond reasonable control, including but not limited to:

  • Severe weather
  • Natural disasters
  • Government restrictions
  • Mechanical or safety issues

4. Acceptance of Terms

By confirming a booking and participating in any expedition, guests confirm that they:

  • Agree to these Terms and Conditions
  • Accept responsibility for their participation
  • Release the Company from claims except where prohibited by law
